This Privacy Policy explains how Setterscaling.com collects, uses, shares, and protects your personal data when you visit our website, submit a form, or book a call with us. We process personal data in accordance with the General Data Protection Regulation (GDPR / in Dutch: AVG) and the Dutch GDPR Implementation Act (Uitvoeringswet AVG).

1. Who we are

Setterscaling.com is the data controller for the personal data described in this policy.

2. What personal data we collect

We only collect the data we need for the purposes set out below.

• Client enquiries and bookings: when you book a call or apply to work with us, we collect your name, email address, phone number, business details, and anything you choose to share with us before or during the call.
• Setter (job) applications: when you apply for a setter role, we collect your name, email address, phone number, links to your public social media profiles (such as Instagram or Facebook), and the information you provide in the application form.
• Email contact: if you email us, we receive your email address and the contents of your message.
• Technical data: our hosting provider may automatically log technical data such as your IP address, browser type, and the pages you visit, for security and to keep the site running.

We do not knowingly collect data from anyone under the age of 16. We do not collect special categories of personal data (such as health or political data).

3. Why we use your data and our legal basis

Under the GDPR we must have a legal basis for processing your data. We rely on the following:

• Performance of a contract or steps prior to a contract (Art. 6(1)(b) GDPR): to respond to your enquiry, schedule and hold calls, assess applications, and deliver our services.
• Legitimate interests (Art. 6(1)(f) GDPR): to run, secure, and improve our website and business, and to communicate with you about your enquiry or application.
• Consent (Art. 6(1)(a) GDPR): where you give it, for example for non-essential cookies set by embedded tools. You can withdraw consent at any time.
• Legal obligation (Art. 6(1)(c) GDPR): to comply with tax, accounting, and other legal requirements.

4. Who we share your data with

We do not sell your personal data. We share it only with service providers (processors) that help us run our website and business, under appropriate data processing agreements:

• Netlify – website hosting and security.
• Airtable – processing of setter application forms.
• Calendly – scheduling and booking of calls.
• Our email provider – for receiving and responding to messages.

We may also disclose data where required by law or to protect our legal rights.

5. International data transfers

Some of our service providers are based outside the European Economic Area (EEA), including in the United States. Where data is transferred outside the EEA, we rely on appropriate safeguards such as the EU-U.S. Data Privacy Framework and/or the European Commission’s Standard Contractual Clauses (SCCs), so that your data continues to receive an adequate level of protection.

6. How long we keep your data

We keep personal data only for as long as necessary for the purposes for which it was collected:

• Enquiries and bookings that do not become clients: up to 12 months.
• Client records: for the duration of our relationship and the legally required retention period afterwards (for tax and accounting records, generally 7 years under Dutch law).
• Setter applications: up to 12 months after the application, unless you ask us to delete them sooner or you are hired.

7. Your rights

Under the GDPR you have the right to:

• access the personal data we hold about you;
• have inaccurate data corrected (rectification);
• have your data erased (the “right to be forgotten”);
• restrict or object to our processing;
• receive your data in a portable format (data portability);
• withdraw consent at any time, where processing is based on consent.

8. Cookies

Our website itself does not set tracking cookies. However, tools we embed (such as Calendly and Airtable) may set their own cookies. For details, see our Cookie Policy.

9. How we protect your data

We take appropriate technical and organisational measures to protect your data, including a static website with a strict content security policy, HTTPS encryption, and limited access to personal data.

10. Complaints

If you have a concern about how we handle your data, please contact us first so we can help. You also have the right to lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

11. Changes to this policy

We may update this policy from time to time. The date at the top shows when it was last changed. Please review it periodically.
